Actress Brooke Mueller goes back to court – but this time, she’s the one who’s taking the legal action, and it’s against a rehab clinic she went to.

Reports say Charlie Sheen’s ex-wife, Brooke Mueller, filed a lawsuit against The Canyon at Peace Park. It is a rehab facility in Malibu which allegedly leaked information to the media about her stay there back in February 2010.

“The World According to Paris” star filed her complaint against the drug and alcohol clinic, The Canyon, on October 3, 2011 for invasion into private affairs and violating her constitutional rights to privacy as well as fraud, negligent hiring, negligent supervision and infliction of emotional distress. Media outlet E! News confirmed that a judge has set a trial date for The Canyon lawsuit on January 9, 2013. However, both sides will be speaking to an arbiter some time soon.

Allie Weinstein, the attorney of Brooke Mueller released a statement saying they are “thrilled with the judge’s decision,” adding, “We obviously look forward to going to trial.”

Tonia Arey, the former employee who gave away information about Mueller’s admission into The Canyon in 2010, said in a declaration that she “was never given a manual on employee protocol or expectations” and “never attended any meetings where the importance of patient confidentiality was discussed.”

In the lawsuit, Brooke Mueller stated that she was assured all information about her time at the rehab facility would be kept confidential and that maintaining privacy was why she chose to enter recovery at that location.

Actress Brooke Mueller was lucky to strike a plea deal and not serve time behind bars after cocaine possession and assault charges have been dismissed – but someone is clearly not happy with the judge’s decision to let Mueller free. It’s none other than the alleged assault victim of Brooke Mueller, Llana Little.

Little, the woman who claims Charlie Sheen’s former wife attacked her in Aspen last year, told TMZ that she is not surprised Brooke Mueller was not sentenced to serve time, saying: “Rich people get what they want and poor people don’t.”

As previous reports have stated, Mueller struck a plea deal with prosecutors regarding the incident back in December 2, which she agreed to plead guilty to cocaine possession. In exchange, the judge handling the case decided to dismiss the misdemeanor assault charge and another cocaine charge. The 34-year-old Mueller was only sentenced to one year probation.

On the other hand, Llana Little, Brooke’s alleged victim said, “I knew this was going to happen … I already prepared myself for Brooke not getting jail time.”

Llana Little says she has no plans to file a lawsuit against Brooke Mueller over the alleged attack, explaining, “It is what it is.”

While Brooke Mueller made headlines after she got out of rehab and avoided charges for her recent arrest due to cocaine possession, someone is clearly not happy the way these events turned out to the advantage of the actress – her alleged victim in the recent bar assault, Llana Little.

According to TMZ reports, Llana Little said that Brooke Mueller does not belong in rehab – she belongs behind the cold bars of prison.

When Mueller was arrested, her lawyer was able to hammer out a plea bargain with Colorado prosecutors, where Brooke Mueller will perform community service and attend drug education classes and the charges will be formally dismissed. However, Llana Little, the woman Mueller allegedly assaulted the night of her arrest at Aspen nightclub, is totally outraged about the situation. She insisted that Brooke Mueller “should go to jail” for hitting her.

Llana Little told her side of the story – she claims that she was coming off the dance floor inside a nightclub on December 2nd when she accidentally bumped into Brooke Mueller. Words were exchanged, and when Little turned around, Mueller punched Llana Little in the back.

Brooke Mueller then left that club and went to another one, where the authorities eventually dragged her back outside and arrested her for cocaine possession and third degree assault.

Llana Little, a key witness in the Aspen case, added, “She needs to learn her lesson that what she did was not okay.”

It seems like actress Brooke Mueller is blessed with good luck as she is unlikely to spend jail time after being formally charged with cocaine possession with intent to distribute last week. According to sources, Yale Galanter, lawyer of Brooke Mueller is hammering out a plea bargain with Colorado prosecutors which will result in a “deferred prosecution” for his client. This is likely to mean that Mueller will perform community service and attend drug education classes before the charges will be formally dismissed. The said cocaine possession charges stem from her arrest in Aspen Colorado on December 2, 2011.

Last week, prosecutors filed one count against Brooke Mueller for possessing more than four grams of cocaine, which is said to carry a sentence of up to six years behind bars. Prosecutors also added another count, a cocaine possession charge for holding just under four grams of the controlled substance. In addition to that, Brooke Mueller has also been charged with assaulting a woman during that evening.

The actress’ troubles began when she was arrested for assault and drug dealing last December after she spent the night clubbing in Aspen, Colorado. A woman at the club contacted police and claimed that Brooke Mueller assaulted her, leading to the arrest of Sheen’s ex-wife due to cocaine possession and alleged assault.

After her arrest due to cocaine possession and assault, Brooke Mueller will now be focused on staying sober in the outside world, and will have the support of a ‘sober companion’ to help her, reports say. Brooke’s spokesman, Steve Honig said last week, “After successfully completing an intensive three-month drug and alcohol treatment program, Brooke returned to Los Angeles yesterday. She has immediately begun an aggressive outpatient program that includes a sober companion.” Honig added, “Brooke is feeling better than ever before, and is committed to continuing treatment for as long as necessary to maintain her total and complete sobriety.”

Steve Honig also released a statement following Brooke Mueller’s decision to re-enter rehab: “After further reflection and consideration, Brooke has decided to remove herself from the media spotlight and has entered a long-term in-patient treatment centre where she can focus on her recovery without distraction. Brooke’s goal is to maintain her sobriety and she believes this is the best option to reach that goal.”

 

After being arrested for cocaine possession and assault on another woman at a nightclub, actress Brooke Mueller is currently facing charges for the misdemeanor she has done recently. However, one of the witnesses to the altercation and drug possession charges against Mueller might not be of much help.

According to the reports, one of the key witnesses to Mueller’s misbehavior was too wasted to actually recall the events and testify against the ex-wife of Charlie Sheen, Brooke Mueller. A man named Keith Reineke,  one of the people on the prosecutor’s list of potential witnesses to the actress’ drug case says he was put on the list because he was at the Aspen nightclub where Brooke Mueller was partying before her arrest. However, the testimony of Keith Reineke might be totally useless, because Reineke said he was “completely hammered” that night and has very little memory of what actually happened before Mueller was arrested.

Keith Reineke added, he didn’t see Brooke Mueller with drugs nor did he see her have a violent altercation with anybody on the club, but that certainly does not mean the incident did not happen. Reports say the prosecution might just be wasting their time putting Keith Reineke on the stand to be a witness against the 34-year-old Mueller.

Charlie Sheen’s ex-wife, Brooke Mueller, has been formally charged with two felony counts of possession with intent to distribute, and cocaine possession, 4 grams or less stemming from Mueller’s drug arrest in December 2011. Pitkin County prosecutor Arnold Mordkin also charged Brooke Mueller with third-degree assault.

According to a statement released by the police, the charges against the actress come nearly three months after they responded to a tip that Brooke Mueller had assaulted another woman at the Belly Up nightclub on the night of December 2. The police took Brooke Mueller outside, arrested her early morning of December 3, and found her in possession of cocaine. Aside from the press release, local authorities have been silent about the details of the arrest. The police report has been withheld on Mordkin’s basis that the alleged crimes remain under investigation, but the charging document named the alleged assault victim as Llana Hora Castillo Pacheco Little of Snowmass Village.

Published reports say Brooke Mueller is attending a rehab facility to treat her drug and substance-abuse problems. Quoting medical privacy laws, Yale Galanter, one of Mueller’s defense attorneys, declined to discuss that detail of the actress’ life.

“I can tell you Brooke is complying with all of the conditions of her release, not only in the written letter of the law but the spirit of the law,” Galanter said in a statement. “She is doing phenomenally well and I mean that from the bottom of my heart.”

Prosecutor Mordkin, on the other hand, did not talk bout how or if Mueller’s stint in rehab will affect her cocaine possession and assault charges. He said, “Generally speaking, it’s always good for people to show that they have come to grips with a problem and are willing to change their behavior.”

Brooke Mueller has yet to make her first court appearance for the cocaine possession and alleged assault. Both Mordkin and Galanter said that they expect Mueller’s first scheduled court date, set for March 5, to be continued at a later date.

Actress and real estate investor Brooke Mueller is finally out of the rehab facility, reports say. Mueller, ex-wife of ‘Two and a Half Men’ former star Charlie Sheen, has been reunited with their young sons after completing her stay at a sober living house.

After checking into the rehab facility on Thanksgiving in November 2011, the treatment group of Brooke Mueller is said to have felt that the actress was ready to leave. The 33-year-old Mueller is reportedly thrilled to be reunited with twins Bob and Max. The reunion came as the twins’ father, Charlie Sheen, continued to cause concern amongst well-wishers with his behaviour.

According to previous reports, Brooke Mueller was taken to the rehab facility by Paris Hilton’s mother, Kathy Hilton. Mueller had been filming a reality series with the socialite before she went into the rehab facility.

Sources told Radaronline that Brooke Mueller was the one who made the decision to get help, telling close friends that she ‘felt weak’ and needed professional counselling. The mother of twins had also reportedly suffered health problems, after an extremely disorganized time due to her marriage problems with Sheen.

“Brooke had a very tough year… she almost died from pneumonia,” one source told Radar. But now it appears that Brooke Mueller is on the path to recovery, now that she is reunited with her loved ones.  According to the insider, Mueller  was having separation anxiety whilst in the rehab facility.

“The hardest part of sober living was being away from the boys every night. She hated saying goodbye to them every night,” the source said.
