“Mission Impossible” star Tom Cruise will not be pressing charges against the drunk guy who trespassed on his property.

According to reports, Bert Fields — the lawyer of 50-year-old Tom Cruise — said in a statement to media outlet TMZ: “Tom’s not a vindictive guy,” adding, “The guy was drunk. He didn’t have a malicious intent.”

Previous reports have stated that a guy named Jason Sullivan — an Australian model/interior designer/reality star — has been living next door to Tom Cruise at the home of Kevin Huvane, Tom’s agent.  Jason came home drunk Sunday night, mistook the actor’s property for Kevin’s and began to enter the grounds. Tom’s security told Jason Sullivan to leave, but instead, he tried scaling the privacy wall to get further into the actor’s property. Jason then began walking toward the house of Tom Cruise and was warned he would be tased if he continued. When he kept walking, Jason was tased twice.

Jason Sullivan was arrested, cited for misdemeanor trespassing and released.

Beverly Hills cops will likely refer the case to the Los Angeles County District Attorney, but given that it’s a an ordinary misdemeanor, it’s likely Jason Sullivan will not be prosecuted.

“Mission Impossible” star Tom Cruise has just filed a $50 million defamation lawsuit against magazines that claimed he had abandoned his daughter, Suri, following his divorce from wife Katie Holmes.

According to Bert Fields, the attorney of 50-year-old Tom Cruise, the actor filed the lawsuit in the United States court in Los Angeles against the publishers of celebrity magazines “In Touch” and “Life & Style.”

The October 1st cover of In Touch shows a picture of Suri above the headline, “ABANDONED BY DADDY,” while the headline of Life & Style reads “SURI IN TEARS, ABANDONED BY HER DAD”

In the lawsuit, Tom Cruise claims the headlines of the celebrity magazines are nothing but false. In a statement, lawyer Bert Fields said “Tom is a caring father who dearly loves Suri. She’s a vital part of his life and always will be. To say he has ‘abandoned’ her is a vicious lie. To say it in lurid headlines with a tearful picture of Suri is reprehensible.”

The lawsuit stated that the September story from “In Touch” claimed that six-year-old Suri, the only child of former couple Tom Cruise and Katie Holmes, had gone more than 44 days without seeing her father.

Fields said that despite repeated stories in gossip websites and celebrity media about the actor and his personal life during his 30-year Hollywood career, the actor rarely resorted to litigation.

“He’s not a litigious guy. But when these sleazy peddlers try to make money with disgusting lies about his relationship with his child, you bet he’s going to sue,” Fields added.

Fields went on to slam the mags for the articles published about Tom Cruise abandoning Suri, saying, “These serial defamers are foreign owned companies with their global headquarters in Hamburg. They take money from unsuspecting Americans by selling their malicious garbage.   Having to pay a libel judgment may slow them down.”

Tom Cruise is seeking damages of $50 million and would “undoubtedly give the money to charity” if he wins the defamation case, said Fields.

The celebrity magazines, owned by privately held German publishing group Bauer Media, did not immediately return calls for comment on the issue.

Previous reports have stated that Katie Holmes filed for divorce in June after six years of marriage from Tom Cruise, seeking sole custody of Suri. This was a move that took the actor by surprise when he was filming for a new movie in Iceland. The two agreed to a custody arrangement and settled other matters but details have been kept private.

According to reports, a New York judge signed off the legal docs on Monday — less than two months after Katie Holmes filed for divorce from “Mission Impossible” star Tom Cruise.

After just five years of being married, former “Dawson’s Creek” star Katie Holmes filed the divorce papers on June 29, seeking sole custody of their six-year-old daughter Suri Cruise — a decision which reportedly blindsided Tom. In the divorce documents, Katie said that her marriage to Tom was “irretrievably broken” for at least six months before she decided to file the papers. back In July, the couple reached a quick settlement, which granted actress Katie the primary custody and gave the actor generous visitation rights.

Even before the power couple got married, the relationship of Tom Cruise and Katie Holmes have been the center of a lot of media attention, after the “Rock of Ages” star famously declared his love for the actress while jumping on a couch on “The Oprah Winfrey Show.”

This was the first marriage for 33-year-old Katie Holmes, and the third one for Tom Cruise. The actor was previously married to actress Mimi Rogers from 1987 to 1990, and to Nicole Kidman, from 1990 to 2001. Tom has two adopted children with Kidman — Isabella, 19, and Connor, 17.

Tom Cruise and Katie Holmes tied the knot in an Italian castle back in November 2006 after dating for just one year.

In light of their finalized divorce, the former couple released a joint statement, saying, “We are committed to working together as parents to accomplish what is in our daughter Suri’s best interests. We want to keep matters affecting our family private and express our respect for each other’s commitment to each of our respective beliefs and support each other’s roles as parents.”

According to reports, Attorney Bert Fields, the lawyer of the 50-year-old actor, condemned a report from “Life & Style” magazine that is said to be “grotesquely false” and has a “bogus cover headline that Suri has been ‘ABANDONED BY HER DAD’” amid the ongoing divorce battle with his soon-to-be-ex-wife, Katie Holmes.

Attorney Bert Fields added that the cover story of “Life & Style” magazine was clearly designed to make some profit out of the falsehoods about Tom Cruise and Suri Cruise.

“The tabloids are at it again, trying to make a buck by publishing more grotesquely false claims about Tom Cruise,” Fields said in a statement, adding that Tom Cruise had been reunited with Suri after he finished his work on his latest film.

“For example a sleazy magazine calling itself Life & Style has a bogus cover headline that Suri has been ‘ABANDONED BY HER DAD’. That, as anyone knows who saw their photos together yesterday and today, is a disgusting, vicious lie,” said Attorney Bert Fields.

“Until this week, Tom was shooting a film on location, but he spoke to Suri every day. He’s with Suri right now; and he was with her the day before Life & Style trumpeted their cruelly false accusation.”

Fields then concluded, “Tom Cruise dearly loves Suri and the last thing he would ever do is abandon her.”

Katie Holmes, the wife of Tom Cruise, announce that she was filing for divorce on June 28, ending her five-year marriage to the actor, who was reportedly taken completely by surprise with the news.

Lawyers of the soon-to-be-former couple, who tied the knot back in November 2006 after their whirlwind romance and a proposal made by Tom Cruise beneath the Eiffel Tower in Paris, struck a divorce settlement less than two weeks later.

Actress Katie Holmes has already set up a new home in New York and is believed to have primary custody of Suri Cruise, while Tom has been spotted spending time with her daughter in Manhattan in the last two days.

Rumors about the reason for the celebrity couple’s separation has revolved around Katie Holmes reported concerns about Tom’s plans to draw Suri Cruise closer into the Church of Scientology, of which the actor is probably the most famous member.

Former celebrity couple Tom Cruise and Katie Holmes have already cut off all contact with each other, and it is reported that Katie’s people are making it difficult for the “Mission Impossible” actor to have contact with his daughter.

According to sources who are familiar with the situation of Tom and Katie, the actor’s people are trying to negotiate with Katie over when and how Tom Cruise can talk to Suri. TMZ sources said that Tom speaks with his daughter over the phone at least once a day, but sources close to the actor say it hasn’t been easy. Sources added that when Tom talks to Suri on the phone, there is only one topic he has not yet discussed … the breakup of his marriage with Suri’s mother, Katie Holmes.

As for when Tom Cruise will attempt to see his daughter, Suri, sources claim that it’s not going to happen for awhile. He was in Los Angeles on the fourth of July, but will be leaving before the weekend to shoot his new movie in the Rockies.

TMZ sources added that things are “really bitter now” between Tom Cruise and Katie Holmes. He feels betrayed by the actress and thinks she is using Suri as a weapon against him.

Tom Cruise and Katie Holmes were reportedly both in New York City during the weeks leading up to Katie filing for divorce. However, the soon-to-be former couple did not stay under one roof.

According to TMZ sources, the 49-year-old Mission Impossible actor was in town for a few days around the 10th of June to film an upcoming movie. However, Tom Cruise did not stay in his and Katie’s apartment in NYC — rather he stayed at The Greenwich Hotel. Meanwhile, Katie Holmes was going back and forth the apartment she and Tom shared, and a new apartment that she recently rented, added the TMZ sources.

The sources also said that Katie brought Suri to visit his dad at the hotel where the actor stayed, but it was only for a few hours and that those visits were unplanned. The security of Tom Cruise did not even know that the two were coming.

According to the people who shares the same building with Tom Cruise and Katie Holmes, they cannot remember the last time they had seen the actor. TMZ sources said that while the couple was having issues, Tom did not have any idea that a divorce was on the way and that his entire team was caught flat-footed by Katie’s filing.
