Weston Gosa of “16 & Pregnant” arrested for DUI on drugs

Reality star Weston Gosa of MTV’s “16 & Pregnant” has been arrested due to an alleged driving under the influence of drugs on July 4.

According to reports, 23-year-old Weston Gosa, who appeared in Season 1 of “16 & Pregnant” crashed the vehicle he was driving on a road not very far from his home in rural Floyd County, Ga. The police found some prescription drugs on the reality star’s car — Lorcet and Xanax — along with a pipe with residue.

Weston Gosa was allegedly driving under the influence of the prescription drugs, for which he did not actually have a prescription. So what is the difference between an alcohol-related-DUI and drug-related DUI?

The difference between the two lies in how the DUI is determined. Generally, DUIs that are alcohol-related require proof that the blood-alcohol level of the driver was over 0.08%, typically by using an alcohol breath test, or what is commonly called a breathalyzer. In Georgia, the police must generally take two subsequent breath tests to make the results admissible in court. Georgia law allows police officers to attempt doing the breathalyzer tests no more than two times.

For an alleged drug-related case like the DUI arrest of Weston Gosa, a breath test will not work. Instead, Georgia law calls for a chemical test of a driver’s blood, urine, or “other bodily substance.” Only a doctor, lab technician, nurse or other qualified person is allowed to conduct this type of test.

Just like all the other states in America, Georgia has an implied consent law. It means that when a driver applies for a license, he also consents to alcohol or chemical tests in case he is pulled over for a suspected driving under the influence. In the event that a driver refuses to undergo such testing, he may face an automatic license suspension, among other penalties.

Aside from the DUI charge of Weston Gosa, he was also charged with possession of controlled substances and objects that are drug-related.Whitney Purvis, mother of Gosa’s son, Weston Jr., reportedly separated with him last fall, this according to The Hollywood Gossip website.
